Understanding and Checking Your KRA Tax Obligations

A KRA PIN is not just a number; it dictates what taxes you are legally obligated to pay in Kenya. Failing to file returns for active obligations leads to automatic monthly penalties. Learn how to identify and manage your tax obligations.

1. What are KRA Tax Obligations?

Tax obligations are specific tax types registered under your KRA PIN. For most Kenyan citizens, the default obligation is Resident Individual Income Tax. However, if you are employed, own a business, or import goods, other obligations may apply.

Common obligations include Value Added Tax (VAT), Pay As You Earn (PAYE) for employers, Income Tax - Rental Income, and Corporate Income Tax.

2. Checking Active Obligations on Your PIN

To check your active obligations, you can inspect your KRA PIN certificate or log in to the iTax portal. Under your profile registration details, a table lists all active obligations, their registration dates, and status.

If an obligation is active, you must submit a return for it every filing period, even if it is a Nil return.

  • Resident Individual: File annually by June 30th (penalty is KES 2,000 for late filing).
  • VAT: File monthly by the 20th of the following month (penalty is KES 10,000 for late filing).
  • PAYE: File monthly by the 9th of the following month.

3. How to Cancel or Amend an Obligation

If you no longer run a VAT-registered business or no longer earn rental income, you should apply for obligation de-registration or suspension on iTax. Leaving an unused obligation active will accumulate severe automated penalties over time.

Frequently Asked Questions

Do I need to file VAT returns if my business had no sales?

Yes. If the VAT obligation is active under your KRA PIN, you must file a 'Nil VAT Return' every month before the 20th deadline to avoid the KES 10,000 late filing penalty.

Can I have both individual and business obligations on one PIN?

For sole proprietorships, business obligations (like VAT or PAYE) are registered directly under the owner's personal KRA PIN. Limited companies, however, receive a separate corporate KRA PIN with distinct obligations.
